§ 1 Information about the collection of personal data

(1) In the following we provide information about the collection of personal data when using our website. Personal data means all data which can refer to you personally, e.g. name, address, e-mail-addresses, user behaviour.

(2) The responsible party according to Art. 4 Para. 7 EU-General Data Protection Ordinance (DS-GVO) is the restaurant Raue Betriebsgesellschaft mbH, represented by the managing director Marie-Anne Raue, Rudi-Dutschke-Str. 26, 10969 Berlin, office@tim-raue.com (see under imprint).

(3) When you contact us by e-mail or using a contact form, we store the data you share (your e-mail address, possibly your name and your telephone number) in order to answer your questions. We delete the data that we accumulate in this context and delete it once it is no longer necessary to keep it, or we restrict the processing if legal retention obligations apply.

(4) If we make use of contracted service providers for certain functions of our range of services or want to use your data for advertising purposes, we will notify you below in detail concerning the specific procedures. We will also name the specific criteria for the storage period.

 

§ 2 Your rights

(1) You have the following rights against us with respect to your personal data:
– Right to disclosure,
– Right to correction or deletion,
– Right to restricting processing,
– Right to object to processing,
– Right to data transferability.

(2) You also have the right, to submit an objection to our processing your personal data with a data protection supervisory body.

 

§ 3 Collection of personal data when visiting our website

(1) When you simply use our website for informational purposes, meaning you don’t register or otherwise share information with us, we only collect the personal data which your browser transmits to our server. If you want to view our website, we collect the following data, which we require technically in order to display our website to you and assure its stability and security (legal foundation is Art. 6 para. 1 p. 1 lit. f DS-GVO):
– IP-address
– data and clock time der query
– Time zone difference from Greenwich Mean Time (GMT)
– Content of the query (concrete page)
– Access status/HTTP-status code
– Data volume transferred each instance
– Website, from which the query came
– Browser
– Operating system and its interface
– Language and version of browser software.

(2) In addition to the data mentioned above, cookies will be saved on your computer when you visit our website. Cookies are small text files that are saved on your hard-drive and assigned to the browser that you use and through which the agent that placed the cookie (us in this case) receives certain information. Cookies cannot execute programs or transfer viruses to your computer. They only serve to make our internet services overall more user-friendly and effective.

b) Transient cookies are automatically deleted when you close your browser. These include especially session-cookies. They store a so-called Session-ID, with which various queries from your browser which make it possible to assign it to the shared session. c) Persistent cookies are automatically deleted after a certain pre-set period which can be different depending on the cookie. You can delete these cookies at any time in the security settings of your browser.
d) You can configure your browser-setting as you desire and e.g. refuse to accept third-party-cookies or all cookies. We must inform you that you may not be able to use all of the functions of this website.

 

§ 4 Other functions and services of our website

(1) Along with the purely informational use of our website, we offer various services, which you can use if you are interested. To this end you must as a rule enter additional personal data, which we use to perform the various services and to which the aforementioned principles of data processing apply.

(2) In part we make use of external service providers when we process your data. We select and assign them carefully. They are bound by our directives and are regularly monitored.

(3) Furthermore, we can share your personal data with third parties if participation in sales, prize competitions, conclusion of contracts or other services that we offer jointly with partners requires it. Your will receive more detailed information about this when you enter your personal data or below in the description of our range of services.

(4) To the extent that our service providers or their partners have their main office in a state outside of the European Economic Area (EEA), we will notify you of the consequences of this circumstance in the description of our offer of services.

 

§ 5 Objection to or Revocation of Consent in Processing Your Data

(1) If you have given consent to processing your data, you can revoke it at any time. Revoking consent in this manner will influence the reliability with which your personal data is processed after you have declared your revocation.

(2) To the extent that we processing your personal data based on the weighing of interests, you can lodge an objection to this processing. This is the case if the processing is not specifically required to fulfil a contract with you, which we will lay out in each case in the following description of functions. When exercising such a right to object, we ask that you state the reasons why you do not want us to process your personal data. If you present a justifiable objection, we will review the facts of the case and either cease processing your data or adapt it or provide you with our urgent and justifiable reasons for continuing to process your data.

§6 Use of Google Analytics

(1) This website uses Google Analytics, a web analysis service of Google Inc. (“Google”). Google Analytics uses so-called “cookies”, text files that are stored on your computer and which make it possible to analyse your use of the website. The information generated about your use will as a rule be transferred to a server owned by Google in the USA and stored there. In the event that IP-anonymisation is activated on this website, your IP-address will first be abbreviated by Google within the member states of the European Union and other contract states to the agreement on the European Economic Region. Only in exceptional cases will the full IP-address be sent to a server owned by Google in the USA and abbreviated there. Google will use this information on commission for the operator of this website in order to evaluate your use of the website, to generate reports about website activities and to perform other services associated with the use of the website and the internet for the website operator.

(2) The IP-address identified by Google Analytics from your browser in this context will not be combined with other data by Google.

(3) You can prevent cookies from being stored with the matching setting in your browser software; however, we must notify you that in this case you may not be able to use all functions of this website in their full scope. You can also prevent the recording of the data generated by the cookie and referring to your use of the website (incl. your IP-address), its being sent to Google as well as the processing of this data by Google by downloading the browser plug-in available under the following link and installing it: (http://tools.google.com/dlpage/gaoptout?hl=de)

(4) This website uses Google Analytics with the extension “_anonymizeIp()”. This abbreviates IP-addresses before they are processed any further, therefore making any linkage with your person impossible. To the extent that any personal reference with the data collected about you is generated, it will then be immediately shut down and the personal data will then be immediately deleted.

(5) We use Google Analytics in order to analyse the use of our website in order to regularly improve it. We can improve our services and make it more interesting to you as a user by using the statistics generated. Google has subjected itself to the EU-US Privacy Shield for those exceptional cases in which personal data are transmitted to the USA, https://www.privacyshield.gov/EU-US-Framework. § 7 Social Media

(1) We are currently using the social-media-plug-in from Facebook. We are using the so-called two-click-solution. This means, if you visit our site, basically no personal data will be shared with the plug-in provider at first. You can recognise the plug-in provider by the marking on the box above the first letter of its name or by the logo. We offer you the option of directly communicating with the plug-in provider using the button. The plug-in provider only receives the information that you have called up the matching website in our online presence when you click on the marked field and activate it. Additionally, the data mentioned under § 3 of this declaration will be communicated. In the case of Facebook, the IP-address is, according to their statements, rendered anonymous immediately after it is collected. By activating the plug-in your personal data will also be transmitted to the respective plug-in operator and stored there (for providers in the USA, this means in the USA).

(2) We have no influence on what data is collected nor the data processing procedure nor are we aware of the full scope of data collection, the purposes for which it is processed or the storage periods. Nor do we have any information about the deletion of the data so collected by the plug-in-provider.

(3) The plug-in-provider stores the data collected about you as a user profile and uses it for the purposes of advertising, market research and/or adjusting the design of its website to match use. Such analysis is done especially (even for users who are not logged in) in order to display advertisements matching your site use and in order to notify other users of the social network of your activities on our website. You have the right to object to the generation of this user profile, whereby you will have to contact the provider of the specific plug-in so that you can exercise this right. Using the plug-ins, we offer you the option of interacting with the social networks and other users so that we can improve our services and make our services more interesting for you as a user. (4) Sharing data proceeds independently of whether or not you have an account with the plug-in-provider and are logged in there. If you are logged in with the plug-in-provider, the data we collect about you will be directly assigned to your account with the plug-in-provider. If you press the activate button and e.g. link to the site, the plug-in-provider also stores this information in your user account and shares your contact data publicly.

There you will also receive additional information about your rights in this matter and the settings options for protecting your privacy.

§ 8 Integration of Google Maps

(1) We use the service from Google Maps on this website. This allows us to display interactive maps for you directly on the website and makes it easy to use the map function.

(2) When you visit the website, Google receives the information that you have accessed the corresponding sub-page of our website. Additionally, the data named under § 3 of this statement will be transmitted. This is done independently of whether Google provides a user account on which you are logged in or there is no user account. If you are logged in with Google, your data will be directly assigned to your account. If you do not want your data connected to your profile with Google, you have to log out before you activate the button. Google will save your data as a user profile and will use it for the purposes of advertising, market research and/or adjusting the design of its website to better match use. Such analysis is especially used (even for users who are not logged in) to provide advertising that complies with your use and in order to notify other users of the social network of your activities on our website. You have the right to object to the generation of this profile but you must contact Google to exercise this right.
